Changes to California Prop. 65 List

Last year, the California Office of Environmental Health Hazard Assessment (OEHHA) voted to list Bisphenol A (BPA) as a hazardous chemical under California’s Safe Water and Toxic Enforcement Act, also known as “Prop 65.” The vote triggered a one-year period for manufacturers, distributors, and retailers to implement “clear and reasonable” warnings for products that contain BPA.  

BPA is an industrial chemical that is used to make certain plastics and resins. Most notably, plastics marked with recycle codes 3 and 7 may contain BPA. Moreover, OEHHA has not established a “safe harbor” level, meaning that businesses that produce, distribute or sell products in California that contains any level or trace of BPA without proper Prop 65 labeling or warnings may be subject to litigation or penalties starting May 11, 2016.
